Participant Terms & Conditions, Waiver and Indemnity
By booking or participating in an AUSshooting activity, each participant acknowledges that clay target shooting and the use of firearms involve inherent risks. Each participant confirms that they have read, understood and agreed to the following Terms & Conditions.
1. Participant Eligibility
Participants must:
- Be at least 12 years of age, unless otherwise permitted by law;
- Comply with all applicable firearms legislation and venue requirements;
- Provide valid government-issued photographic identification when required;
- Not be prohibited from possessing or using firearms; and
- Be physically and mentally capable of participating safely.
Final approval to participate remains at the discretion of AUSshooting instructors and authorised range personnel.
2. Acknowledgement of Risk
Participants acknowledge that shooting activities and the use of firearms involve inherent risks, including serious injury, permanent disability or death.
By participating, each participant voluntarily accepts these risks and agrees to follow all safety instructions, range commands and venue requirements.
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot legally be excluded under Australian law.
3. Mandatory Safety Requirements
Safety is the highest priority at every AUSshooting activity.
All participants must:
- Arrive at least 15 minutes before the scheduled commencement time;
- Attend and complete the compulsory safety briefing;
- Follow all instructions from instructors and authorised range personnel;
- Obey all range commands and venue rules;
- Wear approved eye and hearing protection;
- Wear suitable clothing and fully enclosed footwear;
- Handle firearms and ammunition only when instructed; and
- Keep all firearms pointed in a safe direction.
Participants must never touch, load, unload or otherwise handle a firearm or ammunition unless specifically instructed and authorised to do so.
4. Alcohol, Drugs and Medication
A zero blood alcohol concentration applies to all participants.
Participants must not participate while affected by:
- Alcohol;
- Illegal or recreational drugs; or
- Prescription or non-prescription medication that may impair judgement, coordination, alertness or safe firearm handling.
AUSshooting may refuse or terminate participation where an authorised person reasonably believes a participant is impaired. No refund will normally be provided in these circumstances.
5. Medical Conditions and Physical Fitness
Participants must advise AUSshooting before the activity of any medical condition, injury or physical limitation that may affect their ability to participate safely.
Relevant conditions may include:
- Shoulder, neck or back injuries;
- Heart or cardiovascular conditions;
- Epilepsy or conditions involving seizures;
- Recent surgery;
- Broken bones or significant injuries;
- Hearing or vision conditions; or
- Any other condition affecting safe firearm handling.
Pregnant participants should obtain appropriate medical advice before participating.
Participants must be physically capable of safely handling the firearm provided under instructor supervision.
6. Right to Refuse or Terminate Participation
AUSshooting may refuse entry or immediately terminate participation where a participant:
- Fails to follow safety instructions;
- Handles a firearm or ammunition without authorisation;
- Behaves dangerously, aggressively or inappropriately;
- Appears affected by alcohol, drugs or medication;
- Places themselves or another person at risk;
- Is legally ineligible to participate; or
- Breaches these Terms & Conditions or venue rules.
No refund will normally be provided where participation is refused or terminated for any of these reasons, except where required by law.
7. Bookings and Payments
A booking is confirmed once the required payment or deposit has been received.
Outstanding balances must be paid before or on the event date unless otherwise agreed in writing.
Participant substitutions may be accepted before the event, subject to eligibility, availability and approval by AUSshooting.
8. Cancellations, Rescheduling and Refunds
Unless different conditions are displayed and accepted at the time of booking:
- Cancellation 1–7 days before the event: 100% cancellation fee;
- Cancellation 8–14 days before the event: 50% cancellation fee;
- Cancellation 15 days or more before the event: Payments are refundable, less any reasonable and non-recoverable booking or payment charges;
- Private group bookings: Deposits may be refundable when cancelled more than 30 days before the event;
- Group rescheduling: May be permitted where practical and agreed by AUSshooting; and
- Gift vouchers: Non-refundable, except where required by law.
No refund will normally be provided for non-attendance, late arrival resulting in missed participation, or removal for breaching these Terms & Conditions.
Nothing in this section limits a participant’s rights under the Australian Consumer Law.
9. Weather and Event Changes
Activities may proceed in most weather conditions.
AUSshooting or the venue may postpone, modify, suspend or cancel an activity because of:
- Severe weather;
- Fire danger;
- Unsafe range conditions;
- Equipment failure;
- Safety concerns; or
- Circumstances outside its reasonable control.
If AUSshooting cancels an activity, affected participants will be offered a rescheduled booking, booking credit or refund, as appropriate.
10. Damage to Equipment or Property
Participants are responsible for deliberate, reckless or negligent damage they cause to firearms, ammunition, equipment, facilities or venue property.
AUSshooting or the venue may recover the reasonable cost of repair or replacement.
11. Photography and Media
AUSshooting may photograph or record activities for promotional, advertising, educational, website and social media purposes.
Participants who do not wish to be photographed or recorded must notify AUSshooting before the activity begins.
Permission should be obtained from a parent or legal guardian before identifiable images of a participant under 18 are used.
12. Spectators, Clothing and Venue Rules
Spectators are welcome where permitted by the venue. All spectators must follow venue rules, safety requirements and instructions from authorised personnel.
Spectators may be required to sign a waiver before entering a shooting range or restricted area.
Participants must wear suitable clothing and fully enclosed footwear. Singlets, open-toed footwear, camouflage clothing where prohibited, and clothing displaying offensive, discriminatory or inappropriate material may not be permitted.
13. Health, Vehicles and Personal Property
Participants must not attend if they have a contagious illness or another condition that may reasonably place instructors, staff, other participants or members of the public at risk.
Vehicles and personal belongings are brought onto the venue at the owner’s risk.
To the extent permitted by law, AUSshooting is not responsible for the theft, loss or damage of vehicles, equipment, clothing, valuables or other personal property.
14. Privacy
Personal information collected by AUSshooting may be used for:
- Booking administration;
- Participant safety;
- Legal and regulatory compliance; and
- Communication relating to bookings and activities.
Personal information will be handled in accordance with applicable Australian privacy laws.
15. Release, Waiver and Indemnity
To the fullest extent permitted by law, participants release and discharge AUSshooting, its officers, employees, instructors, volunteers, contractors, agents, affiliated clubs, shooting grounds and venue operators from liability for injury, loss, damage or death arising from participation.
Participants indemnify AUSshooting against claims, losses, damages, liabilities, costs or expenses arising directly from their negligent, reckless, deliberate or unlawful acts or omissions.
These Terms & Conditions are governed by the laws of the Australian State or Territory in which the activity is conducted.
Participant Acceptance
By booking, signing, electronically accepting or participating in an AUSshooting activity, the participant confirms that they:
- Have read and understood these Terms & Conditions;
- Understand that shooting activities involve inherent risks;
- Have had the opportunity to ask questions;
- Agree to follow all safety instructions and venue requirements;
- Confirm that the information they have provided is accurate; and
- Voluntarily agree to participate subject to these Terms & Conditions.
